Legal complications are increasing day by day and many cases are pending from many decades. On basing of the above cases other cases are emerging and increasing anywhere in the India. About 60% to 80% legal cases are regarding the fixed property and created affiliated cases only. Due to the increasing of these cases in the courts they are unable to handle the cases in time due to the criminal attitude and behavior of the litigants. These cases are pending even for decades. To solve this, Root level planning is needed.

State or Central governments should reduce the stamp duty and also other charges to the lowest charges ( whatever the word – Fee or Tax mentioned ) for all sale registrations, agreements, leases, mortgages or any other kind of transfers.

1.) In general due to the heavy and increased charges the people are not able to register the documents in time or skipping or the registrations. There may be many kinds of reasons. This is leading to the Notary or GPA registrations which is also complicated in many times and in many ways. People are going for the oral or agreements on a paper in the presence or witness of some local persons only. This is leading to many complicated social problems and increasing criminal attitudes, litigations behavior among the people. Political People and others know this but they never try to solve this by the root level solutions. If there are such problems in the society, they never loose their identity as a leader and income. So they overlook this. Due to this cheating + illegal activities + corruption + black money, gundas, rowdies will increase in the society and also in the departmental persons. If once the criminals or litigants enjoy the fruits for this type of attitude, then they will grow like anti-social people in the society. If the registration structure is burden to the people then there will be the confusing of the value of the property, like… Market value, Registration value, Sale value and Actual Value. People are confused in this way and the persons involved in this get benefited.

2.) The concerned registrations are completed in far away places in the registration offices. After completing the registrations, it is creating allegations and quarrels in the purchasers and sellers. People will think that the registration is completed but the purchaser is not be able to get handovered the land properly. Local people or relatives and many other will interfere in this and the results effects badly on the purchaser. Some times the sellers are also effected badly. We can observe this in almost every village, town or city. The governments will declare that after registration, the purchaser is completely protected. When the allegations are started and if purchaser consults the registration office, they say that you have to enquire prior to the registration and it is the responsibility of the purchaser and if any problem is there you may go to the Court. Here Property owner/s enjoyed by receiving the money, Registration office enjoyed by collecting the registration charges and its departmental persons enjoyed the forcible benefits from the purchaser. And at last the purchaser is in the trouble. So now we can ask one question… What is the need of registration and the registration department employees..? If any legal heir claims or objects, if any other person claims or objects regarding the property after the registration is over, and then the purchaser is the biggest fool in this game. The property rights are kept under pending up to the judgment. Why the government doesn’t declares the 100% property rights to the purchaser, because the purchaser paid all government’s payments to acquire the rights after the registration. Then what is the value of the registration of a property. A common man or a lay man or an educated man in general will not have such knowledge or intelligence to make personal enquire regarding any matter in this and also they will not get correct answers. As the govt body is large it should protect the purchaser and its rights of purchase. If this is not done then there is no value of the Registrations of the property. Then why we have to register the property in Registration department? Are these registrations for the unwanted tensions among the people? Then Selling and purchasing a property can be done on a piece of paper in the presence and witness of the local leaders or gentleman or local people or any other. If any problem rises then they will solve the problem.Why to register in the Reg. dept and getting financial burden + tensions again and again

And is this for loosing the hard earned or saved money by the purchaser? After the registration, if that sold out property legal successors comes on the screen, why the Registration Department or the Government doesn’t declare that it is the legal problem of sharing the received money in between the seller and that legal successors. But why the purchaser is kept always in the troubles? And why the Govt. doesn’t take up this as the criminal case on the seller ? The sharing of the received money from the purchaser will be in between the seller and his successors or any others. Why the Purchaser/s is every time in trouble?? What is the meaning of cash payment for the Registered purchased property including the registration? Why the purchaser should be affected badly after paying the entire money and registration made on his name by the government department?? Actually the purchaser’s right should not be disturbed.

3.) And there is one more common problem for all purchasers of the properties. Double or multiple registrations made by the same seller to different purchasers. The same property is sold by the seller to different and a number of purchasers with an intention to cheat the purchasers. What the Registration department is doing? Is it simply to get revenue from the people? Departments must check this for the sake of the public because they are charging the registration fee and stamp duty or any other. If the Governments escape for taking care on the purchaser’s rights … then what is the meaning of the Government’s registration department? Showing dirty clauses and escaping this is not a dignity part of the Government. Because its body is most powerful and stable and evergreen than the purchasers and the sellers. And the People always respect and love their Country and the Governments.

The root level solution for majority problems for these registrations is… The registrations should be made in their Gram panchayath office only. After confirming the sellers and purchasing persons, photos and signatures and witnesses – the gram panchayath should forward the registration document to the registration department for their entry in records and for further verification or process to be made by that department. During this processing period, all villagers will come to know that the land or property concerned to some person is going to be registered or mortgaged or lease to any to some other person/s and then if any legal / any other complaint / problem is there in that particular dealing it will be disclosed to all the people and the purchasers. If this is implemented throughout India, This will become authentic in the villages or towns and the people will come forward and give the solutions for the problems and registrations will be done on that same day or on the next day. Or after solving the problems only the purchaser will come forward to pay the money to the seller and proceeds for the registration of the property. Hence in this way majority of the complications in the property dealings will be nullified in a single step.

After completing the registrations then the registration department itself should send the details only within one or two days to all concerned departments. It is the Government duty to protect the rights of the purchaser.

If the registrations are done in some other place other than that particular property situated village or town or city then no one will know regarding the dealing except only some persons who may also be the cheaters or without any knowledge regarding the problems and they support the sellers. Due to this there is 100% chances to cheat the purchaser. Hence the registrations must be done in the same Gram Panchayath where the property is situated. This will clear all allegations and legal problems regarding the property because the concerned persons or related persons or known persons will inform the facts of the property to the purchaser. If this process is implemented then the purchasers or the investors will be safe. And due to this every one will have clarity regarding the property deal so that the complications and the legal cases will be reduced to maximum extent.

4.) If any one tries to sell or sells his/her/their property as 2nd or multiple times with or without registration/s then he/she/they should be punished severely. And in the same way witnessed persons should also be punished equally and severely by recovering the paid money and also by issuing Non-bailable warrant..

In the same way if any one tries to sell any property which doesnot belong to his/her/their property should be punished more severely with non bailable warrents along with the witnessed persons. The same severe punishments for the witnessed persons are also needed.

5.) And the governments should cancel and withdraw all facilities permanently for their life time of the cheaters. If any one is government employee in their house they should be terminated immediately. If they are doing any businesses then their all permissions should be cancelled permanently. Then only the criminals will not dare to do such acts.
